Office of the Attorney General: Rules Proposed on Racing Commission Procedures, Simulcasting Fund
FROM THE OFFICE OF THE ATTORNEY GENERAL
August 02, 2008
Date of Proposal: July 21, 2008
Proposal Number: PRN 2008-237
Proposal Description: The proposal is to adopt new rules -- N.J.A.C. 13:70-1.32 through 13:70-1.41 -- regarding the practices and procedures of the New Jersey Racing Commission and its Executive Director relative to horse racing. The rules are proposed in response to a court directive issued concerning the distribution of the $1.8 million Casino Simulcasting Special Fund (accumulated in 2005.) Among other things, the new rules codify procedures followed by the Racing Commission regarding the submission of information for its consideration, and establish a schedule for doing so. The proposed rules also address the issue of requests by interested parties to comment prior to Racing Commission action at a scheduled public meeting. The rules also address protocols for applying for a portion of the Casino Simulcasting Special Fund, the jurisdiction of the Racing Commission in disbursing money from the fund, and the procedure for appealing any final disbursement decision made by the Racing Commission.
Summary of Proposal: A detailed summary of the proposed rules is posted on the New Jersey Racing Commission Web site at:
